"'na roba", the Franciscans of the Immaculate and the New Chess Move of the Congregation of Religious

The Commissioner and a slander campaign

Tosatti sees "from the outside," a "variety" of reasons leading to the provisional administration of the Order: first the attack against the founder by a group of "young Turks" who wanted to take over the Order, "one of the most flourishing with vocations." Today the vocations must be imported, contrary to the Vatican directives, which provides training on location, from Nigeria), but then also for property, "na roba", the "reason".

What Tosatti does not mention, however, is to be guessed at: that the Order which had changed with Pope Francis, and with the Motu proprio Summorum Pontificum, had changed from the new to the traditional form of the Roman Rite, and yet (or precisely for this reason) attracted numerous vocations while the "modern", "cosmopolitan" orders dried up. Benedict XVI held his protective hand over this extraordinary case among Catholic religious orders. With the new pope, the defeat of the Order began, as it was evidently a thorn in the eye.
The assumption of background touched upon by Tosatti in any case helps to understand the "angry slander campaign" which was unleashed against sisters of the Order because of alleged abuses. The starting point of the campaign in November 2015 was with Corriere della Sera, the flagship of the Italian "quality press". The alleged "scandal" led to investigations by the prosecutor's office, which concluded a year later and was unceremoniously archived. The media claims proved to be what one would call Fake News today.
"However, they will probably have a sequel to some newspapers and websites with severe financial consequences, because they are civilly faced with high claims for damages by the victims," ​​Tosatti said.

There are now fresh actions of the Roman Congregation of Religious. It is not so much about the Cardinal Prefect, the Brazilian João Braz de Aviz, but "about the secretary of the Congregation, the Franciscan José Rodriguez Carballo, who has a direct connection with the Pope," says Tosatti.
Carballo is one of the first personnel decisions of this pontificate. Pope Francis proclaimed him on April 6, not four weeks after his election, as Secretary of the Congregation of Religious. Until then, the Spaniard was Minister General of the Franciscan Order. As such, he is directly involved in the financial scandal that exploded in December 2014 and brought the general leadership of the Order to the brink of bankruptcy. The Swiss public prosecutor's office had seized accounts of the Franciscan Order in October 2014 because of the suspicion of money laundering. The money, several tens of millions of euros, had been invested in ill-fated companies, which are being investigated for illegal arms and drug trafficking. Nothing is known of consequences of any kind against Carballo in the Vatican.
This brings us to ",na roba", which is not insignificant in the Order of the Franciscans of Immaculata (canonically recognized in 1990, not to be confused with the Franciscans, founded 1210/1517). It has about 59 buildings, 17 properties, five photovoltaic plants and a series of banking accounts. The entire property, however, is not in the hands of the Order, since it has the vow of strict poverty, but in the hands of lay associations. The proceeds from the estate were given to the Order for its duties in pastoral care and mission.
When the Order was placed under the Commission, the first Commissioner, Father Fidenzio Volpi, a Capuchin, who died in office in 2015, had the property confiscated. The court then decided completely differently. The entire assets were released again and reunited with the lay associations.

As the Congregation of Religious could not get at the Order through the secular courts, it is now exerting pressure on the now 84-year-old founder of the Order, Father Manelli. Since the provisional administration, he has been under house arrest by the Vatican, "which in 2017 is in extremely bad taste," says Tosatti.

Recently, Father Manelli officially and in the name of the Pope was asked to renew his allegiance of loyalty and obedience to the Pope. The demand appears to be doubtful, since officially no reproaches have been made by the founder of the Order. This, however, has deprived him of the possibility of defending himself for whatever reason. Father Manelli did not contend, but renewed the required oath.
Two weeks ago, he received another letter from the Congregation of Religious. This time he was asked to make the entire property available to the Church, as mentioned above.
"Naively, the founder of the Franciscans of the Immaculata responded," says Tosatti, that he can not provide anything because he has nothing. The above-mentioned assets are not subject to his authority, but to that of the lay associations.
Father Manelli evidently did not see through the "trap" which had been made for him with the renewal of his loyalty first and then the money demand. Maybe he's just too honest, too old or too tired to dodge the trappers with prudentia.

"Perhaps he would have done better to meet with the laity and to present the Vatican demand to them.The laity, who are not under obedience, would have made a decision. But he did not apply this ruse."

The "weapon of obedience" and an "act of disobedience"

His response is now interpreted by the Vatican as an act of disobedience to the Pope. With the letter one wants to turn him with a rope. In other words, in the Congregation of Religious, it is now believed that they have the occasion to impose sanctions against the founder in the Church. And all without being told by the Vatican why the Order is under commissionerial administration, and why Father Manelli was deposed as General-General.
In the Vatican, someone is obviously rubbing his hands. So far, the Congregation of Religious and Pope Francis have been wrong. In which state can sanctions be imposed without charges, without the possibility of defense and without a regular canonical procedure? Now, however, one must not talk about it any more, because one has the statement by Manelli, who answered truthfully, but not satisfactorily. Is this for an ecclesiastical condemnation? In the face of the bad experiences the Order has had to overcome for the last four years, no one in the Order would doubt it.
The real concern, however, is "'na roba", the property. Manelli is particularly stifled, because he can not "relinquish" the possession of valuable property. Legally, he is unquestionably in the right, which is why the Vatican operates the moral lever. The exact disposition of the lay associations are not known, but they can be seen. For a long time the hope existed (and perhaps still exists) that the Order of the Franciscans of the Immaculate could be reestablished in the bosom of the Pontifical Commission Ecclesia Dei, then it would have the means to continue its work blessedly. Such a new foundation has been prevented by the Vatican for four years. Yet another reason is not insignificant: it can be argued that the benefactors who have given the estate to the Order have left it to the Order founded by Father Manelli. Not to any order or in general "of the Church," but in a very particular order with a very definite charism. However, after four years of commissionership, it is no longer the same order.
"As a sidenote" it is also addressed, again to quote Marco Tosatti, "that it is more and more frequent that obedience is used as a weapon. Let us recall how Fra Matthew Festing, the Grand Master of the Order of Malta, was forced by the Pope to resign and sign a letter of doubtful content, by obedience. A bad habit, which is at the risk of becoming chronic ... "

Highest Court Confirms Judgment in the Case of the Franciscans of the Immaculata

(Rome) The Supreme Court in Rome has confirmed that the founder of the Franciscan Friars of the Immaculate and the lay organizations related to the Order are guilty of doing nothing wrong.  The confiscated real estate property must be returned to the lay organizations.
In late June, the rumored reason for the provisional administration of the Order of the Franciscan Friars of the Immaculate had dissolved into nothingness."Rumored" because was no reason was named for appointing an apostolic commissioner by the Vatican until today. Behind closed doors rumors were spread that it had allegedly been an irregular shifts of assets, including the suggestion that it might be someone who was enriched. It was a slander  which was directed against Founder Manelli to discredit him. A court sentenced Commissioner Volpi to pay 20,000 euros compensation for the false claims.

When the Commissioner Came with the Prosecutor

After the first Commissioner, Father Fidenzio Volpi from the Capuchin Order, could not lay his hands on the real estate owned by the lay organizations affiliated with the Order, he  summarily confiscated the real estate ownership by the public prosecutor. In June  the competent Judicial Senate of Avellino  established that no irregularities were present and ordered the release of the seized property.
Shortly before the verdict of Avellino, Commissioner Volpi had died and been replaced by the canon lawyer Fr Sabino Ardito from the Salesian Order. It  had been hoped there would be a relaxation. But Father Alfonso Bruno was still a driving force in the conflict applies Father Alfonso Bruno in the Franciscans of the Immaculate, who had rebelled against Founder Father Stefano Maria Manelli. After the dismissal of the General Government under the Superior General, Father Manelli,  Pater Bruno then became the Secretary-General and therefore became the right hand of the Commissioner.

In any case an appeal was filed against the judgment of Avellino, on behalf of the Commissioner. The Second Criminal Chamber of the Supreme Court in Rome has rejected the appeal, thus confirming the judgment of Avellino. The release and return of the seized property ownership to the lay organizations of the Order is now final.
Part of this property is also that of the religious house in Rome, where Father Alfonso Bruno is domiciled. "With the decision of the Supreme Court the last word in the matter,"  said Alfonso Rocco, the legal counsel of the Lay Association Mission of the Immaculate Heart.

A thriving religious order of tradition was unbearable to the Congregation of Religious

The order launched in 1970 by Father Stefano Maria Manelli  is committed to tradition. Under Benedict XVI. the Order became, according to the motu proprio, Summorum Pontificum was pastorally birituell and internally old ritual. Since the Order was not under the Pontifical Commission Ecclesia Dei for old rite communities, the Congregation of Religious  made it ​​an exception in the Church. Under Benedict XVI. it was regarded as an attractive model, which aroused the interest of young members of other religious orders, since the Franciscan Friars of the Immaculate, despite their strict habit, had a large following.
This combination of factors is thought to be in close religious circles  as the real reason for the provisional administration.  A thriving, tradition related Order, which grew in the midst of widespread vocations crisis,  had become unbearable for many.  But Pope Benedict XVI. held his protective hand over the young religious. Under Pope Francis and his declared aversion to tradition,  the conditions were established to take action against the Order. Four months after taking office, the Order was placed under provisional administration.
The parents of the Founder are recognized as a servants of God. The beatification process is running.The Order was gagged by the provisional government, but not the lay organizations related to the Order.  They continue to see in Founder Manelli their reference point. With the court ruling, their position relative to the Commissioner has been significantly strengthened.

Animus Delendi Against the Franciscans of the Immaculate Continues -- Obsessive Micromanaging by Bergoglian Bureaucracy

(Rome) The battle against the  Franciscans of the Immaculata continues. Hardly had Pope Francis mounted the throne of Peter, than the opponents of the traditional rite in the Order felt themselves strong enough, with his agreement, to place the once thriving men's branch of the order under a provisional administration.  The women's branch "only" received an apostolic delegate as an overseer, but was still drawn in sympathy with the men's Order because of its close spiritual and institutional connectedness. With a confidential decree of 19. October 2015, the Roman Congregation for Religious reinforced its resolve to proceed further against the men's and women's branches of the Order. In his decree Pope Francis is obliging the women's order to avoid a "special vow" or "solemn promise." What this involves can be read herein.  

The New Decree

"Because of credible information about a private vow (or promise) of special obedience, which is reserved to some male and female religious to the founder, which has been placed above the general vows of obedience owed to the superior, has prompted this dicastry to bring this problem to the attention of the Holy Father, who has given a special mandate to deal specifically with this problem.

Therefore, the Congregation for the Institute of Consecrated Life and for the Societies of Apostolic Life in enforcing this mandate for the good of the souls of all members of the Franciscans of the Immaculata, and all eventually bound to these institutions, by private vows (or promises) of a special nature to founders or foundresses.


In consequence it will be necessary that in future this vow or promise in future is not practiced either in its current or any future form.

With that this annuls any document, should such exist,  in its value, such that it involves in any way the vow (or promise) named here.  

It is the obligation of responsible authority in both institutes to make these stipulations known in a measured and discrete way to all members belonging currently to the institutes so that they can know how they are to respond if any have been placed under such a vow.

Superiors will be instructed by the Dicastry about the times and modalities for the introduction of this decree.

Aspirations for a New Old Rite Establishment

The Decree by the Congregation of Religious which was in turn adopted with papal approval, says at the outset that there were "credible" reports. The decree itself reveals, however, that the Vatican has adopted it on the basis of conjecture, without having any concrete evidence. The decree thus sounds like a new shot across the bow, which clarifies that the religious congregation remains determined to disrupt  order from recognition and to subject it to re-education.  Anyway, nothing should be remain of  the actual charisma of the Order.
The fact is that there are, since the Autumn of 2013, efforts of monks and nuns to found a new religious in which the true charism lives. That charism of fidelity to tradition and the rediscovery of the traditional rite, which had led the Order to its heyday and was shattered by the raging, appointed in 2013 and now deceased Apostolic Commissar, the Capuchin Fidenzio Volpi.  So far, however, nothing is known about a "special vow." 

Congregation of Religious Unwilling to Allow Reestablishment

The Congregation appointed a new Commissar last June with  Salesians Sabino Ardito, and there was hope that he would lead the Order with a calmer hand. However, the Congregation of Religious does not seem willing to grant such a rest. Above all, it seems to want to prevent the Franciscan Friars of the Immaculate from carrying out a new religious foundation. Commissar Volpi had warned  Italian Bishops during the General Assembly of the Italian Bishops' Conference not to take Franciscan Friars of the Immaculate in their dioceses.
As early as autumn 2013. dozens brothers had applied to the Congregation of Religious to be released from their religious vows. The canonically compliant departure from  the altered Order should have given them the opportunity to ask for incardination in dioceses and free them up for the path to reestablishment of an Order. The Congregation has refused until today, however, such a dispensation. Cardinal Braz de Aviz and Pope Francis do not want the Order of Franciscan Friars of the Immaculate 2, since the Order of the Franciscan Friars of the Immaculate 1 have placed under provisional control ​​and broken. 
Thus, the brothers are forced by the Congregation to remain in the Order, although this is no longer the same Oder since the provisional administration than the one which they were originally committed to.  Should they leave without a dispensation of the Order, which have a number of well done, this puts them canonically in the wrong.  Each Bishop, or superior of another order, and especially by the Vatican could go against them in the field, since they are not in a canonically regular position. In short their lives would be  on end of a  rope indefinitely. It's a situation that brings brothers and sisters into a fitful moral dilemma. Above all, one does not change an order like a shirt.

What is at stake in the matter: A brief review

The ordeal of  Father Manelli's order, who was ousted from the Order until the summer of 2013, so continues. Reminder: The Order of the Franciscan Friars of the Immaculate was created after the Second Vatican Council. While other orders over abruptly "modernized", Father Manelli went the opposite way and wanted to return to the roots of the Minorite Order, to which he belonged at the time. He joined an increasing number of young men and women, so in 1990 a new foundation was necessary for religious revival of the Order of Friars Minor of St. Francis of Assisi.
Under Pope Benedict XVI.   the young discovered, with the blessing of numerous vocations,  the traditional rite. The priests concelebrated in for reasons of pastoral care in both forms of the Roman Rite. Internally the Order underwent the change from the new rite to the traditional rite. The result was an even more rapid growth of the Order, which would then set up a number of new monasteries and take over  pastoral care in parishes and sanctuaries.
The Order did not belong, because of its development, to the old ritual Ecclesia Dei -communities but was under the Congregation of Religious like all new rite communities.  That made ​​it an anomaly that was before 2013, an example to all th other new rite orders.
Thus arose also a violent resistance within the Order. The resistance of a small internal minority, who would not  tolerate the traditional rite. For the same reason there was also resistance from among other church circles who believed they recognized a hazard in the Order. The Franciscan Friars of the Immaculate had a thriving community, and were viewed enviously by the other orders. Above all, it seemed to be the living proof that the often prostrate  nature of religious orders can be revived even in Europe through the stern austerity, tradition and the traditional rite. The Franciscan Friars of the Immaculate were on the way under Pope Benedict XVI. to becoming a potential model for other orders. It was an idea that came not with undivided joy.

With the papal election of 2013, the problems started

Under Pope Benedict XVI. no one dared openly to oppose the Order. The German Pope had returned the traditional rite with the motu proprio Summorum Pontificum to the universal Church. In implementation of this Motu Proprio, the Order had returned to the traditional rite. The German pope was especially closely connected with the Franciscans of the Immaculate, too closely, so that the envious and chief opponents of the traditional rite would never have dared to lay hands.
With the unexpected resignation of Benedict and the election of Pope Francis, the situation had changed radically in one fell swoop. The Argentinian Pope was soon repeatedly recognized for his dislike of the representatives of tradition and also that he retained the traditional rite as  a passing "fad." Now it happened in quick succession.Citing and in cooperation with the small band of five brothers who complained to the Congregation of Religious, Father Manelli and the entire Order leadership were deposed and replaced by an Apostolic Commissar, the said Father Volpi, and he also no friend of the traditional rite. The Order now lacked the protection afforded by the Ecclesia Dei 's own communities.

The Imposition of the "new Mercy"

To this day, the Vatican has offered no reasons for this serious interference. Only unofficial hints by Commissioner Volpi and the Curial Archbishop Carballo, who has been appointed by Pope Francis secretary of the Congregation for Religious could show that it comes to an ideological struggle against tradition and the traditional rite. This is suggested, since celebration of the old rite was banned for all  priests  by decree of the provisional administration. In open opposition to the Motu Proprio Summorum Pontificum every priest of the Order had to individually apply for a special permission to celebrate the old rite again. It was a demonstrative act of reducing and downgrading of the traditional rite, with which the Order members  were   shown what is now required under the new conditions in the Vatican and what is not.
Pope Francis withdrew the possibility from the astonished friars the right to appeal against the decree in opposition to the Congregation of Religious. The case would have ultimately landed before the judgment seat of Cardinal Raymond Burke, the then Prefect of the Supreme Tribunal of the Apostolic Signatura, an incorruptible Canon Law expert and declared friend of the traditional rite. This should be avoided. Basically, as well as the  aforementioned rejection of dispensation, shows that Order members should be compelled for re-education.
Pope Francis has dedicated his pontificate to the theme of mercy. Yet he has showed the Franciscans of the Immaculate anything but mercy.

Franciscans of the Immaculate: Will the New Commissar Also Bring the New Spirit?

(Rome) Since last June, the Order of the Franciscan Friars of the Immaculate have been assigned  the Salesian priest Sabino Ardito, a canon lawyer, as the new Apostolic Commissioner. Yet there is still a demon in the Order, says Messa in Latino.  Father Alfonso Bruno was responsible and  the ultimate beneficiary of the palace coup against Founder Manelli.
Alfonso Bruno, the father with a penchant for self-expression, already belonged to the old leadership the order, where he was responsible for its media presence. At that time he was only one among several. Then came the dismissal of Minister General Father Stefano Maria Manelli and the whole Order leadership by the Vatican. Alfonso Bruno was the one who made the news public through his media contacts and thus - at least initially - of the urgency  of a  radical intervention.

Apostolic Commissioner Father Fidenzio Volpi was then appointed, who was ran like a bulldozer over the Order. The first official act of the Commissioner was the appointment of Father Alfonso Bruno as Secretary General of the Order and thus his right hand.  Excepting the Commissioner, who belongs to the Capuchin Order, Father Alfonso Bruno has since been at the top of the Order of the Franciscan Friars of the Immaculate, and completely alone.
The decisions by which the clear-cutting was done were signed by Commissioner Volpi. Partially also by the Secretary General, in part he remained in the background, as he had done well in advance of the palace coup against the Founder, who embodied the Order's charism  and the Old Rite. But his handwriting appears on the endless flood of corrections, warnings, notifications, which were all issued  since the coup in July 2013,  against those who expressed criticism  of the actions of the Holy See and the Commissioner.

"Disinformation on the Internet"

The most recent example is the correspondence of a lawyer, which the Catholic website  Riscossa Cristiana received by electronic mail on August 4th. In the letter, the editor  and writer are required to   delete  two articles. The lawyer acts in the name of Father Giulio Maria Scozzaro. Both articles dealt with the issue, as well as the title of the second article: "The Franciscan Friars of the Immaculate and the Disinformation on the Internet".
The items were manifestly defamatory and would severely damage the honor of his clients.
The first article reported the facts about the dismissal of Giulio Maria Scozzaro on 4 October 2007 from the Order of the Franciscan Friars of the Immaculate by the then General Superior Father Manelli. It was a decision that was confirmed by the Congregation of Religious on 8 April 2008 after Scozzaro raised opposition  against it. "Facts can not be libelous," said Cristiana Riscossa in response to the lawyer.
In the same article, Scozzaro's publication on his internet blog was criticized, which  can also be read there as before. Therein Scozzaro vehemently attacked Order's founder and his now deposed Superior General, Manelli.

Volpi's Reintroduction of Dismissed Manelli Brother

However there is something now new that has became public, it was at the time of publication unknown.   Initially in the context of the contested articles the lawyer submitted, was a decision of 11 February 2015 where the late Commissioner Volpi annulled  the  Scozzaro's dismissal from the Order and has readmitted him into the Order.
Volpi's amazing justification, which made Manelli's decision null and void  from formal legal reasons, is that  the dismissal is supposed to have  never been legal. Amazing because Scozzaro had lodged an appeal against his dismissal to the Congregation of Religious and  confirmed this after examining the case of   dismissal. Volpi's decision bears his signature and that of Alfonso Bruno. "Does  Commissioner Volpi, have the right or the authority to annul an order  whose validity has been confirmed by the religious congregation?" Asked Riscossa Cristiana .
As an aside  it should be recalled that Father Scozzaro could appeal against his dismissal appeal to the Congregation of Religious. Founder Manelli and the deposed general leadership could not have prevented it by  objecting to the provisional administration. Pope Francis had approved the drastic intervention in a form that made any appeal impossible.
The second article referred to the  collected signatures at that time in support of the Franciscan Friars of the Immaculate and of the Roman Rite. "A report on a petition is also hardly libelous," said Cristiana Riscossa.  Also in this article, the facts of the early dismissal of Father Scozzaro was also reported.
"What can you say about the behavior of a priest and religious who don't directly seek contact and  admonishes  by using worldly means and threatening legal action? For this I will ask the new Apostolic Commissioner for clarification, as well as the bishop of the diocese where  P. Scozzaro is still incardinated. "
The corresponding letter was sent on August 10 to the Apostolic Commissioner and to the Congregation of Religious. The Commissioner immediately acknowledged receipt.

Franciscans of the Immaculate: Court Releases Estate Holdings -- Finds No Irregularities

(Naples) The Court of Avellino has ordered the release of the property that belongs to the lay associations  that are close to the Order of the Franciscan Friars of the ImmaculateThus, another of the accusations bandied about dissolves into nothingness  that have been spread in recent years, spread against the founder and Superior General, Father Stefano Manelli  who was deposed by the Vatican.
The property had been seized at the direction of the late Apostolic Commissioner, Father Fidenzio Volpi. by the district attorney of Avellino. As the traditional Order was placed under provisional administration in Summer 2013, the Commissioner and the leadership of the rebels  realized that the  properties are not in the direct possession of the Order, but belong to the lay associations connected to the Order.

The Ad Hoc Reason for Provisional Administration Dissolves into Nothingness

In this, however, the Apostolic Commissioner did not have access and thus, neither to the property. Nevertheless, in order to lay hands, there were accusations of alleged  irregular transfers of assets. Alleged irregularities have been named in the past two years as the reason why the provisional administration was ordered by Rome. Officially there are no grounds for radical intervention in the life of the Order were announced by the Vatican to this day.
The  judicial panel has now established that there were no irregularities  present and ordered the release of the seized real estate assets worth around 30 million euros.

New Apostolic Commissioner Appointed

Commissioner Volpi's actions were directed against the  lay organizations related to the Order, against the Mission of the Immaculate Mediatrix (MIM) and the Third Order of the Franciscan Friars of the Immaculate (TOFI). There are thousands of believers organized in these these worldwide and connected to the Order.
Just yesterday the appointment of a new Apostolic Commissioner for the Order became known. With the approval of Pope Francis the Congregation of Religious appointed the Salesian, Fr Sabino Ardito, to succeed Father Volpi. The canonist Ardito will lead the fortunes of the Order for the time being until the summer of 2016. Then the three-year period of a regular provisional administration will be finished. The provisional administration could then, however, be extended on a proposal from the Commissioner.
It is not yet known whether the new commissioner is to continue the dismantling of his predecessor or another line will follow.

New Commissar of the Franciscans of the Immaculate: Father Sabino Ardito SDB

(Rome) Fr. Sabino Ardito is the new Apostolic Commissioner of the Franciscan Friars of the Immaculate. He belongs to the Salesian Order of Don Bosco and is a well-known canon lawyer. He teaches at the Pontifical Salesian University in Rome and has been employed in various departments of the Roman Curia.
Father Ardito succeeds  Father Fidenzio Volpi OFM Cap.  who was deceased on 7 June at the age of 75.  Father Volpi had died as a result of a brain hemorrhage suffered on 29 April. The Capuchin had been appointed in July 2013 as the Apostolic Commissioner of the Order, which he left in a disastrous state.
Unlike Volpi, who was the sole Commissioner, Father Ardito is supported by two coadjutors, a Jesuit and a Capuchin. They, too, were chosen from among canonists, that canon law, "which was little respected by the previous provisional administration," said Corrispondenza Romana .

What Now? After the Death of Commissar Volpi?

(Rome) After the announcement of the death of Father Fidenzio Volpi,Vaticanista Marco Tosatti  asks "What now?"
The Apostolic Commissioner of the Franciscan Friars of the Immaculate, the Capuchin Volpi had suffered a serious stroke at the end of April.  His health has since been very critical, so that the news of his death was wrongly been spread a month ago.
From anonymous websites who were close to the Apostolic Commissioner, or rather the small group of rebels within the Franciscan Friars of the Immaculate , who support the provisional government, the false death report was polemically denied. The Secretary-General of the Order, Father Alfonso Bruno said on May 15  no less falsely, Father Volpi stands directly in the forefront of the government of the Order of the Franciscan Friars of the ImmaculateBut  his health never permitted it at any time following the stroke.  Especially Father Alfonso Bruno, the big winner of the provisional administration, became increasingly nervous since the stroke.

Naming of a new commissioner is likely, but  there is also an opportunity for a change of course

The  death of the Apostolic Commissioner has changed the situation abruptly. Therefore, Tossati's question: "What now?" What is the Holy See's reaction? If the provisional administration is to end or will there be a new commissioner? Anyway: Father Bruno can not be certain of his his leading role. An end of the provisional administration seems unlikely. A provisional administration usually lasts at least three years. The religious congregation should appoint a new Commissioner for the remaining time and the final report out in the summer of 2016 to decide whether a General Chapter of the Order can choose a new head of the order.
The naming of  a new Commissioner, however, also makes a change of course in dealing with the Order possible. Had Father Volpi pursued a course of radical devastation, a new commissioner could be benevolent to the Order. Still, however, everything is open.

Commissioner Volpi leaves a field of desolation

Father Volpi leaves the once blooming Order of Franciscan Friars of the Immaculate since July 2013 after only 22 months of provisional administration as a field of desolation. Vocations have plummeted, friars who leave the Order, monasteries have been closed down, the order's own seminary was shut down and the first measure at all, the celebration of the traditional rite has been met  with prohibitions.
While many Catholic orders  in Europe cite a lack of vocations, the Congregation of the Religious have suppressed under the leadership of Cardinal Prefect João Braz de Aviz, one of the most flourishing Orders. Reasons for radical intervention of the young Order is still not known. Behind closed doors were sown notions that  in the Order there were  "crypto lefebvrian" tendencies. See Commissioner Volpi, the Franciscan Friars of the Immaculate and the SSPX under Pope Francis .

Commissar Volpi's Credibility --- Judicial Agreement With Manelli Family Burst

(Rome) Father Fidenzio Volpi, with the approval of Pope Francis in July 2013, has surprised again and again as Apostolic Commissioner of the Franciscan Friars of the Immaculate, although rarely in a positive way. The Apostolic Commissioner has changed his mind and withdrew his signature on the agreement with the family of FFI Founder Father Stefano Maria Manelli.
This past February 12 Commissioner Volpi and the family Manelli had agreed following a mediation in civil matters (mediazione civile). The blog Le pagine di Don Camillo, who first reported on the agreement, falsely wrote about a "patteggiamento", a specialized institution of the Italian Code of Criminal Procedure, and has since apologized.  Since 2010, Italy has recognized in implementation of an EU directive mediation in civil matters, which serves to resolve disputes wherever possible on a voluntary basis, without letting it come to a trial. The mediation takes place before court-appointed mediators at the registered office of the competent court.

FEBRUARY 12: The Admission of Guilt by the Commissar

This past February 12  at 11 clock before the Court Mediator at the District Court of Rome, the family members of Father Manelli and their lawyer Davide Perrotta as plaintiff on the one side and on the other side the Apostolic Commissioner Fidenzio Volpi and his lawyers Alessandra Böcklin and Edoardo Boitani as defendant. The mediation took place in the proceedings pending before the District Court of Rome, First Civil Chamber of litigation for defamation of Manelli family by Commissioner Volpi (see Commissioner Volpi admits a slander ).
At the end of the mediation, both parties signed an agreement with  Commissar Volpi who apologized and explained that with respect to the family Manelli  nothing applied to what he had written in his circular letter dated 8 December-2013. The Manelli family had "absolutely nothing to do with any unlawful act."

The obligations of the Commissar

This public apology would have until March 3rd according the agreement, to be published on the message news agency AGI and on the website of the Order immacolata.com. On the website it would have to be visible for at least three consecutive months in a clear presentation as other published notices on the issue.   In addition, the Commissar was to have informed all monks and nuns, with his apology in a circular. Volpi undertook all attorneys' fees and agreed to pay the family Manelli a compensation of 20,000 euros. Everything by 3rd March. "Can there be even more guilt?" Said Riscossa Cristiana.
Volpi's admission is legally and morally significant. In addition to the legal question before a court of law, the Commissar admitted with having violated the Eighth Commandment. Thus, the credibility of the Apostolic Commissioner is badly hit. Many blogs have pointed this out following the mediation agreement.

February 18: The anger of the Commissioner and an incendiary  letter

But that seems to have so annoyed the Apostolic Commissioner because of the damage to his image that is  now breaking like  porcelain. Referring to the report, he has withdrawn his signature to the agreement again. Instead of writing the court warranted apology, Commissar Volpi has sent  an new urgent letter on the 18th February  to all members of the religious order.
In the newsletter, he withdrew his admission and told the brothers and sisters of his "will" that he would  "not to comply with the signed statement" because he "no longer considers it valid because of serious non-compliance by the other party."  But Volpi  does not say just what the "serious non-compliance" with the family Manelli happens to be. In the written mediation agreement (copy of the original document 1 )) of 12 February 2015, there is no statement obliging the family Manelli as the complainant in the proceedings. Unlike in the mediation agreement, the Commissar has now returned to his initial allegations and is shooting fire arrows at the family Manelli.

"Little credible" Justification of the Commissioner

The Commissar, as is evident from his incendiary letter, is incensed  because the matter became public. "The fact that the news of the agreement signed by Commissioner Volpi would reach the public, was easily foreseeable," said Corrispondenza Romana. However, Volpi may have hoped that certain details, such as the payment of € 20,000 to the family Manelli, would not become known. In addition, the Commissioner was faced with new demands for his resignation. In the circular letter of 18 February he writes now that he has always been considered "innocent". He only agreed "pro bono Pacis" and  "in a spirit of brotherhood seraphic" the agreement of 12 February, which was just for the sake of peace. "A statement of little credibility," said Riscossa Cristiana, given the clear and unilateral commitments into which he entered.
The fact is that Commissar Volpi has not been convicted by any court. The mediation was voluntary. "However, the agreement of 12 February exists and is signed by Father Volpi. The signature may indeed be withdrawn, so is no longer in effect," said Cristiana Riscossa.
Commissioner Volpi is receiving a monthly € 5,000 allowance for his provisional activity, according to Italian media. A message that has never been disowned. The sum is to be paid by the Order of Franciscan Friars of the Immaculate.  Soon, the Commissioner will have to stand trial. With his circular letter, he made it clear that he wants it to come to a trial in this dispute. There, too, the mediation agreement will play a role. The legal costs of the Commissioner shall be borne by the Order.
